1. Definitions

1.1. Reflection period: the period within which the Consumer can make use of his right of withdrawal, being fourteen days calculated after receipt of the Product(s);

1.2. Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the Seller;

1.3. Day: calendar day;

1.4. Right of withdrawal: the possibility for the Consumer to waive the distance contract within the Cooling-off Period;

1.5. Seller: the legal entity that offers Products and/or services remotely to the Consumer, whose identity is stated in Article 2 of these General Terms and Conditions;

1.6. Agreement: an agreement whereby, within the framework of a system organized by the Seller for distance selling of Products, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;

1.7. Product: a Circle of Trust Product offered for sale by the Seller on the Website.

1.8. Conditions: the General Conditions and delivery conditions of the Seller.

These are the general sales conditions of Premium Fashion Brands B.V. (“Circle of Trust” & Circle of Trust Webshop” and these general terms and conditions of sale: the “Terms”).

These Terms and Conditions apply to all orders that the Consumer places with Circle of Trust via the webshop (www.circleoftrust.nl) or otherwise outside a physical retail space. By placing an order, the Consumer agrees to the applicability of these Terms and Conditions to the agreement concluded between the Consumer and Circle of Trust.

These Terms and Conditions set out the rights and obligations of the parties that apply to your order of Products through the Circle of Trust webshop. Article 3: Data Consumer

3.1 In order to enable Circle of Trust to perform the agreement properly and in a timely manner, it is important that the Consumer provides its details, such as name, e-mail address, and shipping address, correctly and completely in accordance with the instructions. The Consumer is responsible for the correctness of the information provided by the Consumer. The full contact details of Circle of Trust can be found under Article 2 of these Terms and Conditions.

3.2 Information provided by Consumers will only be used by Circle of Trust in the manner indicated in the privacy statement. Consumers can consult this Circle of Trust website.

Article 4: The offer and the agreement

4.1 When the Consumer buys an item via the Circle of Trust webshop, the Consumer enters into an agreement with Premium Fashion Brands B.V. (trade name “Circle of Trust” and “Circle of Trust Webshop”). The is established the moment Circle of Trust has sent a confirmation to the consumer agreement.

4.2 An agreement from an offer that contains an apparent agreement and/or error, such as an unusually low price, does not bind Circle. Please contact Circle of Trust if you are unsure about the presentation of an offer.

Article 5: Price and payment

5.1 The price displayed in the webshop at the time of ordering is a total price including all taxes and, if applicable, shipping costs.

5.2 The consumer can complete the payment options indicated in the webshop.

5.3 It is not possible to use Circle of Trust Concept Store gift cards and/or other gift vouchers or savings cards in the Circle of Trust webshop.

5.4 Discount codes, Sale items, and/or other temporary promotions cannot be settled and/or added to previously placed orders.

Article 6: Handling order and delivery

6.1 Circle of Trust makes every effort to process and deliver the Consumer's order as well and as quickly as possible.

6.2 Orders are delivered to the address sent by the Consumer and in the middle of the delivery method chosen by the Consumer.

6.3 When Consumption has an order delivered outside the European Union, it is possible that the country in question charges levies, such as import tax. Circle of Trust has no influence of control over such levies and therefore cannot inform consumption about them. 6.4 Ownership of Products by Consumer transfers to Consumer upon receipt of full payment by Circle of Trust.

Article 7: Quality

7.1 Circle of Trust makes every effort to display Products as accurately and completely as possible on its website. However, the nature of the Products offered means that there may be differences (such as color differences) between the display of Products on the website and the Product as delivered to the Consumer.

7.2 Naturally, the Products from Circle of Trust's range meet the quality that the Consumer may expect. However, it is expressly pointed out to the consumer that these Products are primarily designed from an aesthetic point of view and not with a view to optimal lifespan, practicality, or ease of use.

7.3 The Products offered in the webshop, such as clothing and accessories, are by nature subject to wear and tear. The lifespan of a Product partly depends on the material of which the Product consists, the intensity of use, and the degree of care. The Circle of Trust Products are composed of the materials specified in the webshop. For an optimal lifespan and preservation of quality, it is important that the Consumer observes any washing instructions.

Article 8: Complaints

8.1 The contact details of Circle of Trust can be found under the “Contact” button on the Website.

8.2 The Consumer must inspect the Product upon delivery and inform Circle of Trust within a reasonable time of any defects visible upon delivery or other complaints about the performance of the Agreement. Such complaints must be submitted in writing (email), fully and clearly motivated, as soon as possible.

8.3 Complaints received by Circle of Trust will be answered within a period of 14 days after receipt. If a complaint requires a foreseeable longer processing time, Circle of Trust will make this known to the Consumer within 14 days, stating the time frame within which the Consumer can expect a response.

8.4 The Consumer acknowledges that minor and/or commercially acceptable deviations or technically impossible or difficult to avoid deviations in quality, size, color, finish, etc. with regard to the Products cannot or are difficult to avoid and cannot be a valid reason for a complaint. to be. Such complaints as well as complaints about the fact that certain articles have been withdrawn from the range are unfounded. Seller is not liable for damage suffered by Consumer due to such complaints.

8.5 The Consumer will fully cooperate with any recall action instituted by the Seller. The Consumer will immediately notify the Seller if the Consumer suspects that a Product has a safety defect and is subject to a recall. The consumer must report any complaints within a period of six months after the purchase date. Complaints will no longer be processed outside this period.

Article 9: Right of withdrawal

9.1 The Consumer has the right to dissolve the agreement without stating reasons within 14 days after the Consumer has received all Products from its order. This concerns the so-called reflection period. The consumer can make use of the right to dissolve the agreement by returning the completed return form to the Seller, but this is not mandatory. The Consumer can also inform the Seller in any other way by means of an unambiguous statement that the Consumer wishes to dissolve the agreement (such as by e-mail or by post). 9.2 If the Consumer chooses to dissolve the agreement with regard to a Product, the Consumer has the obligation to return this Product to Circle's address as soon as possible, but no later than 14 days after the Consumer has received all Products from her order. or Trust as stated on the return form. The direct costs of returning the Product to Circle of Trust are for the Consumer's own account unless stated and/or agreed otherwise.

9.3 In the event of termination as referred to in Article 9.1, Circle of Trust will refund the amount paid for the relevant Product (including any shipping costs paid) without delay and in any event no later than fourteen days after receipt of the message that the Consumer wishes to terminate the agreement, but no sooner than after Circle of Trust has received the relevant Product or the Consumer can demonstrate that the Product has actually been returned. If the Consumer has chosen a different shipping method than the cheapest standard delivery used by Circle of Trust when placing an order, Circle of Trust will not reimburse the Consumer for any additional costs in the event of termination.

9.4 The right of dissolution as included in Article 9.1 is intended to determine whether the Product fits and whether the Consumer actually wants the Product. The Consumer is allowed to use a Product to the extent necessary to verify whether the Consumer wants the Product, just as the Consumer would in a retail space. Continued use of the Product – such as wearing the Product in public places or other actual use – affects the Consumer's right of withdrawal as specified in Article 9.5.

9.5 If a Product has been damaged by the Consumer, has been washed, the labels have been removed, a Product is incomplete or a Product contains other traces of use that show that the Consumer has used the Product beyond what is permitted under Article 9.4, the Consumer is liable to Circle or Trust is liable for the decrease in value of the Product caused by the Consumer. Circle of Trust will deduct this depreciation from the amount to be refunded to the Consumer.
Note: This can also mean a 100% depreciation in value, which means that there is no refundable amount

9.6 The right of termination as referred to in Article 9.1 does not apply to Products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.

10.2 If the Consumer has completed the complaints procedure, but the Consumer subsequently wishes to submit the complaint to another body, this can be done with the Disputes Committee via the European ODR Platform: http://ec.europa.eu/consumers/odr/.

11. Intellectual Property Rights

11.1. The Intellectual Property Rights with regard to texts, images, design, data files, photos, and other (still or moving) image material, formats, software, brands, domain names, and other materials, which arise from the website www.circleoftrust.nl are vested in Circle of Trust. , its licensors, the manufacturers of such Products, and/or third parties to whom Circle of Trust is not affiliated.

11.2. The consumer is not entitled to publish and/or reproduce (parts of) the website www.circleoftrust.nl in any way whatsoever. The Consumer may not make any changes to the delivered Products unless the nature of the delivered dictates otherwise or otherwise agreed in writing. Consumers may only provide a hyperlink to www.circleoftrust.nl if this is done for purely informational purposes to Consumers. The establishment of a hyperlink for any other purpose, such as a commercial purpose, is strictly prohibited.

Article 12: Applicable law

12.1 These Terms and Conditions and the agreements concluded between the Consumer and the Seller are governed by Dutch law, with the exclusion of the Vienna Sales Convention. This choice of law does not affect any further protection that the Consumer enjoys on the basis of the mandatory provisions of the law that would apply without this provision.

Article 13: Invalid Provisions

13.1 If any provision of these terms and conditions should prove to be invalid then:
- the other provisions of these terms and conditions nevertheless remain in force;
- and the ineffective provision must be interpreted as or converted into an active provision of the same intent as much as possible

Article 14: Changes to these Terms

14.1 If Circle of Trust decides to change these Terms, it will post the amended Terms on its website. Consumers are advised to regularly check whether the Terms have changed. Any changes do not apply to orders placed by the Consumer before the date of change. These Terms were last amended on November
